It is fair that you can apply for a den which has an idle pack, but there are a few things I must question. I believe somebody applied for den 9, and is now protecting it. But it has been locked the entire time. So that doesn't really give the current pack a chance to keep their den, if they're locked out. Shouldn't there be den-claiming rules?

True enough, it is a little different when claiming an empty den from a den that's already been taken. The locks.
An empty den doesn't have a lock, and makes it much more challenging. But claiming a den from someone else already has a lock, and therefore, way easier to keep your opponent out.
Perhaps there should be a rule that locks are to be remove/not allowed while two different packs are fighting for a den? Nark could implement some Variable DS that if she said something like !denAlock1 it will shut off the power of the lock, and it cannot be used to close the den up. And then, if she says !denAlock2 the locks power would return. I think the dens would have to be named as A, B, C, D... since the Variable DS would probably pick up on the number of the den accidentally and utilize that into it's equations.

You aren't allowed to apply for dens that are already taken. I question Narkili about this a few days ago and she said that if a pack already has claimed that den you cannot try to claim it as your own. She is trying to find out what packs are never on so she can re-open the den.

Indeed, I know how that glitch happens. If someone drops an item on the areas where the lock's boulders are placed and try to lock the den, it breaks the whole thing and cannot be fixed until the dream is re-uploaded. I am unaware of the dream's DS, though, so I am not sure where the error is occurring.
